Provision w.r.t. higher additional fees notified by MCA | Effective July 1, 2022

   Hello,

   I am Company Secretary from Rajkot (Gujarat), I am continuously reading presented by you and it is worth reading as it contains very in depth research.

   From the above Article on Applicability of higher Additional Fees which is applicable from 01.07.2022, I have some doubt in mind. Therefore I have read MCA notification dated 11.01.2022, in which, Schedule of Additional Fees Substituted with New Schedule containing Additional Fees as well as Higher Additional Fees IN CERTAIN CASES. Further, below to the Schedule, note was given that Higher Additional Fees shall be payable in case of INC-22 and PAS-3 on default of two or more occasion within 365 days from last form filed.

   From the above Article one can understand that Higher Additional Fees shall be payable in all Forms (except INC-22 and PAS-3) on third time default and in case of INC-22 and PAS-3 on third time default within 365 days from last belated form filed.

   So I have doubt that whether it is (i.e. Higher Additional fees) applicable in all forms in CETAIN CASES (whether certain cases are define anywhere) or It is applicable only on INC-22 and PAS-3 on default on two or more occasion within 365 days (whether we can take this situation as Certain Case?)

   Please guide me by clarifying the same. It would be very helpful for me as well as our professional community.
